Rent-a-Cop at Shandon Rapids

While trying to portage to the top of Shandon rapids yesterday, I was met be a rent-a-cop who said "Parts of this trail are private property. You can't use it again." Is this accurate? I thought that anything below the high water line is considered public.

I have researched the issue about portaging at Shandon Rapids...The river bank in question is part of the high dollar residential development known as The Reserve....DNR has had telephone conversation with one of the developers and he is symphathic with the paddlers dilema...an amiable solution may be forthcoming...
